1. About these terms
Power of Potential is the master brand for this website and its educational products. Pursuing Your Potential is a self-directed digital educational and personal-development resource for actors, authored anonymously by The Working Actor.
The legal seller is the person or entity identified at checkout and on the purchase record or receipt. The Working Actor is the author's public creative identity. Public author anonymity does not prevent legal identity being provided where it is required by law, a payment provider or the relevant platform.
By using this website or purchasing the product, you agree to these terms. If you purchase through Payhip, Payhip's platform terms and the relevant payment processor's terms also apply to their services.
2. What you receive
Your purchase provides access to the digital PDF materials described on the product page at the time of purchase. Delivery is ordinarily made electronically through Payhip. You are responsible for supplying a working email address, maintaining access to your account or receipt, and using compatible software and equipment.
Unless a product page expressly says otherwise, the purchase does not include live or individual acting coaching, personalised career advice, acting representation, talent-agent services, casting services, introductions, auditions or ongoing support.
3. Personal-use licence and intellectual property
Copyright and all other intellectual-property rights in the website and product materials remain with their respective owners. A completed purchase gives the purchaser a limited, non-exclusive, non-transferable licence to download and use the supplied materials for their own individual, personal and non-commercial education.
You must not reproduce, republish, upload publicly, distribute, share, sell, sublicense, adapt for resale, or make the materials available to another person except where applicable law permits an act despite this restriction or Power of Potential gives prior written permission. Brief quotations for genuine review, commentary or another legally permitted purpose are not prohibited.
4. Payment, access and third parties
The standard course price is USD $99 unless a different price or valid promotional price is shown at checkout. Checkout, payment and digital delivery are provided through third-party services, currently Payhip and Stripe. Applicable taxes, currency conversion and bank charges may be shown or applied by the checkout, payment provider or card issuer. Those providers may apply their own terms, privacy practices, availability rules and technical limits. Power of Potential is not responsible for an outage or failure wholly outside its reasonable control, but will take reasonable steps to assist with a genuine delivery or access problem.
Links to third-party websites are provided for convenience or context. Their content and services are not controlled or endorsed merely because they are linked.
5. Educational nature and outcomes
The product reflects the author's experience, observations, philosophies, exercises and interpretation of ideas. Acting and creative careers involve uncertainty. No audition, representation, booking, employment, income, fame, career success or personal-development outcome is promised or guaranteed.
You remain responsible for your choices, how you apply the material and whether an exercise is appropriate for you. Read the Educational & General Disclaimer before using the product and seek appropriately qualified professional advice where needed.
6. Users under 18
The product is intended for people aged 16 and over. If you are under 18, involve a parent or guardian before purchasing or using it. Where the law requires consent or an agreement by a parent or guardian, the purchase must be made with that involvement. Nothing here states that every person under 18 lacks legal capacity; capacity and enforceability can depend on the person and circumstances.
7. Consumer rights, responsibility and liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the law applicable to you, including the Australian Consumer Law where it applies. To the maximum extent permitted by law, and except to the extent loss is caused by our breach, negligence or other unlawful conduct, Power of Potential is not responsible for loss arising from treating general educational material as personalised professional advice, from decisions made by casting professionals or other third parties, or from events outside our reasonable control. You should take reasonable steps to avoid or reduce loss. This paragraph does not limit liability where doing so would be unlawful.
8. Acceptable website use
You must not misuse the website, interfere with its operation, attempt unauthorised access, introduce malicious code, scrape protected course files, or use the website or materials in a way that infringes another person's rights or breaks the law.
9. Changes to these terms
These terms may be updated prospectively to reflect changes to the products, services or law. The updated date will appear above. The terms presented at the time of a purchase continue to govern that purchase unless a later change is required by law or is more favourable to the purchaser.
10. Governing law and contact
These terms are governed by the laws of New South Wales, Australia. The parties submit to courts with jurisdiction in New South Wales, but this does not deprive you of any mandatory consumer protection or right to bring a claim elsewhere under the law applicable to you.
